Fees and Payments a. Fees for using Maker-Mall.com as a seller are outlined in our Fee Schedule. By using our services, you agree to pay the applicable fees as described. b. Payments for sales made through Maker-Mall.com will be processed securely. Sellers are responsible for any taxes or fees associated with their sales, unless otherwise required by Marketplace Facilitator Laws.

Privacy a. We collect and use personal information in accordance with our Privacy Policy. By using Maker-Mall.com, you consent to the collection and use of your personal information as described in the Privacy Policy and by your consent of Cookies.

Termination a. Maker-Mall.com reserves the right to terminate or suspend your access to the website, at our sole discretion, for any reason and without prior notice. b. Upon termination, you must cease all use of Maker-Mall.com and any content or information obtained from it.

Limitation of Liability a. Refund Policy
Our refund policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange. To request a refund for a course or class, please email the support@maker-mall.com. Once your claim has been received and reviewed, you will be emailed of a decision. If approved, a refund will be issued. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Thank you for choosing Maker-Mall.com as your platform to showcase and sell your products (this includes classes, courses, and lessons). To ensure a positive and consistent experience for all our sellers and buyers, we have established the following guidelines. Please read them carefully and adhere to them while using our platform:

Authentic Products:
All products listed on Maker-Mall.com must be accurately represented and of high quality.
Ensure that the products you list are authentic, legally obtained, and do not infringe upon the intellectual property rights of others.
Accurate Product Listings:
Provide clear and accurate descriptions of your products, including details about requirements or materials needed, length, goals and objectives.
Use high-quality featured images that accurately represent your products.
Avoid misleading or false claims about your products.
Originality and Copyright:
Ensure that your products and listings do not infringe upon the intellectual property rights of others.
Do not use copyrighted images, logos, or trademarks without proper authorization.
Respect the intellectual property of others and refrain from copying or imitating their designs.
Professional Conduct:
Communicate professionally and promptly with buyers, providing excellent customer service.
Respond to inquiries, messages, and order notifications in a timely manner.
Handle any conflicts or issues with buyers in a fair and respectful manner.
Communication:
Provide open and written communication with buyers and parents at all times. In the event of a dispute, we an only back you up if there is written documentation. Communicate with buyers about any delays or issues with their classes/lessons and keep them updated on the status.
Pricing and Fees:
Set reasonable prices for your products, taking into account the value of your craftsmanship, materials, and time invested. Instructors are paid 85% of the billed earnings, unless otherwise discussed with a site admin. If you are a former TakeLessons instructor, please email support@maker-mall.com with a link to your TL profile and your earnings rate will be adjusted. *This must be done by November 1, 2024. Payouts are done via bank transfer or PayPal, upon request of the instructor.
Compliance with Laws and Regulations:
Adhere to all applicable laws and regulations, including but not limited to product safety, labeling, and taxation.
Obtain any necessary permits, licenses, or certifications required for the production and sale of your products.
Honesty and Transparency:
Provide accurate information about yourself, your business, and your products in your profile.
Clearly state your shop policies regarding returns, exchanges, and refunds.
Disclose any relevant information about your products, such as potential allergens or special care instructions.
Reviews and Feedback:
Encourage buyers to leave reviews and provide feedback on their purchases.
Respond graciously and constructively to reviews, both positive and negative, to maintain a professional image. If there is an issue with a review, please email support@maker-mall.com.
Prohibited Items:
Do not list or sell any items that are illegal, hazardous, or violate Maker-Mall.com’s content policies.

Platform Use
Registration: In order to become an instructor on Maker-Mall.com, instructors must register for an account and provide accurate and complete information. Background checks will be required for anyone offering private lessons. the fee for the background check will be at the instructor’s expense.
Eligibility: Instructors must be at least 18 years old and capable of entering into a legally binding agreement.
Account Security: Instructors are responsible for maintaining the security of their account credentials and ensuring the confidentiality of their login information.

Seller Responsibilities
Product Listings:
Sellers must accurately represent their products, including providing clear descriptions, images, and pricing information.
Compliance with Laws:
Sellers must comply with all applicable laws, regulations, and standards regarding the production, sale, and shipment of their products.
Intellectual Property: Sellers must ensure that their products and listings do not infringe upon the intellectual property rights of others.
Customer Service: Sellers must provide timely and professional customer service, including addressing customer inquiries, concerns, and complaints.
Fees and Payments
Transaction Fees: Maker-Mall may charge transaction fees on each sale made through the Platform. The applicable fees and payment terms will be outlined in the Maker-Mall.com fee schedule.
Payment Processing: Maker-Mall will facilitate the processing of customer payments on behalf of the Seller. Payments, minus any applicable fees, will be remitted to the Seller’s designated payment account, set on their profile.
Taxes: Sellers are responsible for complying with all tax obligations associated with their sales on Maker-Mall.com. Maker-Mall is not responsible for collecting or remitting taxes on behalf of Sellers except where mandated by Marketplace Facilitator Laws or Economic Nexus.

Seller Content and Data
Ownership: Sellers retain ownership of their product listings and other content they provide on the Platform.
License to Maker-Mall: Sellers grant Maker-Mall a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute their content for the purpose of promoting the Platform and facilitating sales.
Data Privacy: Sellers acknowledge and agree that Maker-Mall may collect and use their personal data in accordance with Maker-Mall’s Privacy Policy.

Termination
Termination by Seller: Sellers may terminate this Agreement at any time by closing their Maker-Mall.com account.
Termination by Maker-Mall: Maker-Mall may suspend or terminate a Seller’s account for any violation of this Agreement or the Platform’s policies, or for any other reason at Maker-Mall’s discretion.

General Provisions
Independent Contractors: The relationship between Maker-Mall and Sellers is that of independent contractors, and nothing in this Agreement shall be construed as creating a partnership, joint venture, or employment relationship.
Modifications: Maker-Mall may modify this Agreement from time to time, and Sellers will be notified of any material changes. Continued use of the Platform after such notification constitutes acceptance of the modified terms.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Anson County, NC, without regard to its conflict of laws principles.
Entire Agreement: This Agreement constitutes the entire agreement between Maker-Mall and Sellers and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter hereof.

Failure to comply with these Seller Guidelines may result in warnings, account suspension, or termination of your seller privileges on Maker-Mall.com.
